The Lafiel banner can never be removed. It means way too much tomy old donkeythe older members as well as the staff. Removing it would be like trying to remove Albert Einstein from Science Books.

QUESTION:
Can the character in mention be a vocaloid?
On that note, I do realize that it says no fanart BUT - what if it's just a modified version of the character? Not just strictly fanart.. but yeah.
i.e. my sig/avatar being Hatsune Miku's alternate form.
(No I will not be making a banner with the same character in my sig/avatar, it's just pure example)

Vocaloid is okay. There are a few vocaloid banners already in rotation.
As for alternate forms/modified versions... I would say it's fine as long as it's not fan art, but I'll let @blueangel06661 be the final judge on that. If you can provide a stock image of what you're going to use, that would be helpful for her.
Oddly enough I resigned from Banners a few months ago!
So that'll be @FlashD 's call to make, but like DB said a photo of the stock imagine could be helpful (and possibly save you a lot of time being told yes/no upfront rather than going ahead and possibly being told no later).

Depends what you mean by "modified version of the character". If you are just going to use an original stock image or an image you yourself did and then modify that, it's alright, but if you are going to take a fan made image and then modify it, it is not.

Check Mitche's credit. It seems that your image is just Mitche's work with a light filter.
It's def not mictches work 0.o they just made a wallpaper with the render as well. But they didn't draw it.
Edit: The person they credited didn't draw it either, they just cut the image from something.

You're making things way too complicated. Editing even fanart still makes it elligable for use. And if you're paranoid about angry authors just leave a disclaimer in the ToS saying requests by artists to take down banners will be honored. No need to cripple artists like this.

I didn't change the render whatsoever.. I found it just like that on Baka Renders. No editing done except to remove the water mark so I can use it on a banner.
Either way, here's the link to it so you guys can see it and hopefully a hearsay on weather or not to use it.

I'll answer this because I have a bit of knowledge in copyrights, fair use, and the DMCA/takedown notices. I'm not a lawyer so please don't take my word as the law but I have the basic standard public gist of things relating to the topic at hand. Copyright is a pain I know. Editing fanart doesn't make it any less infringing on the artists copyrights. It's their work that they own. Editing it doesn't make you own their work or make them own their work any less; it's theirs. Dealing with an official anime company's IP on an anime based site is much different than dealing with an artist's IP. Rip an artist off of Deviant Art and prepare to have the internet police after you with their fanbase and art justice warriors or whatever they call themselves on DA who go around and reports EVERYTHING. They exist. Honestly it's not crippling artists who rely on OTHER ARTISTS's art by limiting banners to not fan art. It's annoying but it's not bad nor complicated especially when you're gunning for official use type stuff as like the banners and other such things that are kind of the 'face' to the sites.. Yes fan art is often times 100x's better than official stuff but still. As for modifying the TOU's that'd have to be @Kaitou Ace 's call as the owner not the call of any admin or other such staff.
