Judge rules against forcing school to hold prom for lesbians

A federal judge on Tuesday said he would not order a school district to hold a prom that it had canceled after an openly lesbian student asked to attend with her girlfriend.
not much of a new developtment, but that's pretty screwed up that the judge doesn't see it as a bias.
In school,they take away 96% of your rights.

The school is not required to hold a prom, and right or wrong it is not prohibited from discriminating on the basis of sexual orientation. The judge is in the right with this ruling.

I hope she sues not only for discrimination but emotional distress the ruling caused her to face from her peers. Something like this should not happen.

To be honest, I think a lot of people would be grateful to her for cancelling the prom. I know I would.

They ruled that she had been discrimnated against, but that they are not going to force the school to have a prom.

The judge is going to have another formal hearing that her civil rights were violated, but he ruled that he cannot force the school to hold prom. Forcing the school to hold prom is violating their rights. There's no constitutional law that says you HAVE to have a prom.
So in essence the win was for the girl and the ACLU since the judge ruled her civil rights were violated. Please read the whole story before commenting, and lets refrain from only posting the "angry" half story.

If the judge ruled her civil rights were violated, then he is wrong. Civil rights are legally defined and are not infinite. Currently there is no prohibition from discrimination on the basis of sexual orientation, therefor this is an example of judicial activism at its worst. Yes, district courts have jurisdiction in both criminal and civil law, but they cannot make rulings based on anything other than the letter of the law; even if it's the right thing to do, it's the wrong way to do it.
(This discussion can very easily slip into one about incorporation...)

Wow thats pretty messed up. I readed it and I think that school sucks. Theyre wrong as hell for doing that to Constance. She did nothing wrong and superintendent, the school's principal and its assistant principal I hope them bastards burn a painful death.(I hope I can say that without getting in trouble on here) Anyway its time for schools to change alot rules anyway.

If they decided to hold the prom and not let them in, it would be considered discrimination, but they decided to not hold the prom for anyone. May not be fair to those lesbians, but from the legal point of view this decision was not just completely justified, but also the only right one.
This is true. I still can't imagine the warped decision making behind this. Prom is one of the most tame events in someone's highschool career; god forbid these two girls might be caught slow dancing to "Close to You", that would just be indecent.

I had the impression that Prom was the high school equivalent of going out guns blazing on the social scene, and considering the horrors you merry-cans expose each other to in order to climb the social hierarchy, prom should be something akin to the battle of Kursk.

I think that she should've been allowed to bring her date just like a heterosexual couple should. Anything other than that is discrimination.
