On a more serious note, VG555, I hate Nintendo for it's crappy ports of games that are better on the other consoles, and their lack of great games. There are of course a some that are awesome, but most aren't. Like every other console and their selection. Course, there is something for everyone. It also doesn't help that I feel like they get the short end of the stick sometimes, but whatever.

Also, screw Pokemon. I got too old for that game when Red came out. Although I will admit, I do sometimes play the other versions when I'm bored of everything else, but that's the only time.

Because we only hate stupid things who's name starts with a V and ends in three 5's... I mean there's really not a good solid reason to HATE Nintendo. We're still going to give them some money for at least one item in the year. It may be a game purchase. It may be a console purchase. It may be a branded Mario shirt. Either way somehow they are going to get your money and ours.

And to answer your question.. No we don't really hate Nintendo.. It's just you buddy. We may dislike a few things about it but it's all shrug-able to us normal people. We get over it.

Well, there are things that I disagree on, but all things considered you have to keep in mind that Nintendo saved the video game industry, not once, but TWICE!


So I really don't think many people are at liberty to go around ranting about how Nintendo "sucks", when in fact the industry would have died off like every other 'fad' that existed for 10 or so years had it not been for them.

Okay, big baby. Let me clear up your troll confusion so that we can end this stupid tread of yours. Honestly, if you want to have a discussion, you need to learn that not everyone is going to agree with you, that you shouldn't care if people disagree with you, and if they do disagree with you, there are ways of behaving besides "BAAAWWW!! WHY YOU NO LIKE NINTENDO?!"

Listen, as Nintendo pointed out to you, in both their reply email and on their FAQ page, ROMs and emulators are technically illegal (well, emulators generally aren't illegal by themselves, but that is another can of worms). Nintendo basically believes that they are the bane of their existence and wants nothing more than to get rid of them and see them gone. So yeah, ROMs are illegal.

Now, you did bring up a good point (one that has been brought by many people before you). There are not many legal ways to backup video games onto a computer or even the console itself, usually because of the interference of video game developers themselves (especially Nintendo, who loathes the very idea of such a thing). So, while there is a legal loophole that allows people to backup video games, there are limited legal ways of actually doing so (note how I said "limited legal ways"; there are legal ways to make copies of video games).

Like I said, one is allowed to backup a video game (ONCE) in the event that the original becomes unusable (for whatever reason). It is a person's right to do so (17 U.S.C. Section 117(2)). However, bare in mind that whatever backups you make are tied to the original game.

Also, bare in mind that there is a legal grey area when it comes to Nintendo. You see, virtually all of their games come with the stipulation that you can't make copies of the game, regardless of whatever rights you have. This "shrink wrap" contract comes with all of their games, including the old ones. Since one's rights can be negated with the agreement to a contract, if you buy a Nintendo game, you also agree to forfeit your right to backup software. However, "shrink wrap" contracts have been floating around in a grey area of legality for many years (whether it is legal for one to be expected to agree to an unknown contract at the time of purchase), so there is a dispute of whether Nintendo's contracts are legal or not. Of course, courts HAVE upheld "shrink wrap" contracts before, so you would be wise not to violate the ones attached to the games you already have.

So, let's summarize the points I made here:

1. ROMs that you download are illegal (if you make them yourself, then it is not much of an issue). Don't even mention it to Nintendo because they don't even want to hear it.

2. It is legal to make copies of video games. A user has a right to backup software they legally own.

3. There is a legal grey area when it comes to Nintendo and ROMs. Technically, one is allowed to backup video games. However, Nintendo includes shrink wrap contracts that stipulate that one is not allowed to do this. While contracts can negate rights that one is entitled to, such as the ability to backup software (since one agreed to let this happen), shrink wrap contracts have not been consistently upheld in court, causing the legality of Nintendo's contracts to be highly disputable.

Further more, Nintendo's hated of ROM's and emulators causes them to give out information that technically isn't true, as you found out (game copiers are, for the most part, very much legal).

However, there some things I must point out to you:

1. NES and SNES cartridge batteries have a life of about 15-20 years. If you haven't been taking good of them for all of these years, if oxidation, static electricity and broken and eroded contacts haven't gotten to them by now, then the batteries are most likely already dead, making your cause rather pointless.

2. I find it more than hilarious that you took the time to contact Nintendo about the legality of copying your games, only to get so butthurt by their response (or lack thereof), that you are choosing to not only break the law, but are encouraging others to do so as well in the shallow, jaded and down right asinine attempt of trying to get Nintendo to kow-tow to your whims.

Actually, I was sidetracked about how it was a non-issue. How many people with backups of their own games have been legally prosecuted by Nintendo? How many kids who solely use illegal roms have been?

See, that's why I love Nintendo. They never seem to target the little guy - hell, they're also not using any DRM that makes it a pain in the A to play a game legitimately. Yeah, they say they're against illegal copies and everything, well DUH, they're a goddamn business after all, the important thing is how they react, and generally they're a top act.
