So here's the backstory. I'm sitting in my vehicle in a protected left turn lane, with the red light. I get rear ended. The lady hit me kind of hard, but the seatbelt did its job. My back kind of hurts, but where my kidneys are. When I get an adrenaline rush, it always does that. Anyway, we get out and trade insurance info and all, and take a look at the damage. All I could see was a few scratches on my back bumper. Her front end was smashed up a bit, and she will need a new bumper, and probably a nose clip. I'm glad, in this case, that my lights are so high up, as well. Anyway, it's really icy and bad out, which explains why she couldn't stop. Not really, but it's a factor.
I took pictures of both vehicles, as did she, and we left. I have to go to my insurance office in the morning to complete my claim. They gave me the choice since there aren't any known injuries and my vehicle is pretty much unscathed.
The ethics part of the thread is this - It was her fault. She hit a stopped vehicle that was stopped in a place where it is supposed to be stopped. I could claim whiplash, take her for a ride, and possibly make a ton of money.
I'm not going to do that. Why? I don't know. I don't know or care about this woman. Why shouldn't I take advantage of the situation? All I know is that it's the wrong thing to do.
Where does that come from? The economy is bad and my job sucks. It would be logical for me to take advantage.
