That's because they keep porn on their servers, and U.S. law (dunno about other places) requires age confirmation. Not applicable for MySpace, because they aren't legally responsible for anything their users post. There was a landmark case over this in the early 90's. When the service becomes aware of CP, they are legally required to delete it or else they become liable. The possibility that CP may be posted is not relevant legally. This is why Ace hasn't been arrested for CP posted during 'Chan raids. If Myspace kept adult pr0n, they would be legally required to ask for age confirmation.

From how I understand it, that's more of a safeguard against civil suits, the same way the instructions to your toaster tells you not to use it in the bathtub.
There are so many legal hurdles to overcome to actually enforce exposure laws online, that it just doesn't work very well at all. Something as simple as identifying where and when the crime took place (and thus, which laws to use) is a major issue.

Actually, in some countries 14 is the age of consent. Hell, in some countries there IS no age of consent. It's a legal matter, a rather silly one at that, that's the immediate problem here. However, the fact of the matter is that in this culture, it's more likely that she has the knowledge of sexuality but not the maturity to handle that knowledge responsibly. Any way, from what these previous posts seem to be showing- It's law versus natural rights. Or in this case, 'very' natural rights. Sure, a human shouldn't be bound by anything more then his flesh, but we've made 'law' to get rid of the things we don't like people doing to each other. With law comes restrictions, just like with weapons may come protection, and yet they can be used for war.
So even though I have a big respect for what sounds like a sort of pagan-kind of belief, unless the law is changed or abolished we can only view these sort of things based in terms of law. We aren't arguing that your body isn't your wonderland, we are arguing about whether or not that wonderland is open to the general public, and the rules around that. (As well as common sense in the matter)
In my opinion she shouldn't have been slapped in the face as a sexual offender, considering she exploited herself- whether it was knowing or unknowing on her part of what she did. I say they should just slash her Myspace account ability and leave it be.
But that's just my view, whatever the law dictates is how it's going to be. I just hope we come to a more precise scope on these new cyber-laws and what not. (You know its gonna happen)

As a myspacer I can tell you that they don't do checks through every profile. Someone has to report them, or some of the "admins" saw it and BANHAMMERED!

I agree. I can understand a fine, but why arrested? Why such a big deal over a stupid story? A person under 18 should not be put into prison over child pornography. They should be put into a juvi(juvenile detention center). This incident doesn't even deserve a slammer in the juvi.
