    Default Viacom Sues YouTube

NEW YORK - Big Media took its first big swing at YouTube Tuesday as Viacom Inc., the owner of MTV, VH1, Comedy Central and other cable networks filed a $1 billion copyright lawsuit against the video-sharing site and corporate owner Google Inc.

The lawsuit marks a sharp escalation of long-simmering tensions between Viacom and YouTube and represents the biggest confrontation to date between a major media company and the hugely popular site, which Google bought in November for $1.76 billion.

I don't think thats right to sue Youtube. It doesn't show full lenght episodes of stuff without special permission and I think the time limit for something is about 10 minutes.
But its true that Youtube is where I get most of my comedy from since the clips are in order, but isn't it more of a promotional aspect? Before I found Youtube comedians, I never watched Comedy Central. Now I watch it sometimes only because I liked what I saw on Youtube.

You know, people disgust me, and in this circumstance it would be Viacom. All that company cares about is money in their pockets. They run MTV, and we all know how THAT turned out.

YouTube is only being sued, because it's making its profit. It's a well designed thought-out website, and I find it annoying that they want $1 Billion over something so petty. I hope Youtube fights back and wins their case. It's not that serious to be worth that much money.

Have them take it down, and let bygones be bygones.

YES! Oh my (insert deity of choice), yes! This is the kind of thing I've been hoping for. Now if only Viz or Funimation or someone could pull something like this with all of the licensed content on it...

Though I do think that $1,000,000,000 is a little...way...too much. Taking it down should suffice, and perhaps a small fine for not moderating the content well enough, but at it's root, those who uploaded the videos are at fault. And I do agree with Piper about Viacom being after the money.

Well, you have to remember that youtube generates income for Google. That income is being gained by breaking the law and showing copyrighted videos.

When the site was run by a normal person as their own project, the big companies overlooked it. But now that its a corporate goldmine they have to play by the rules.

Personally I hate corporations like Google buying up good quality websites, so personally I hope youtube fails under their control. This isnt to ruin your fun of watching videos, I sincerely hope if youtube does suffer, you find a new video site that is run by an individual and becomes just as good as youtube was.

$1 Billion.... little to much imo.

I think, at worse, they should close down the site if anything is to be done.

You almost make it seem as if they forced the original owners to sell it to Google. They willingly gave YouTube to Google, which gave YouTube the oppurtunity for it be run with bigger (not to mention more) servers.

Yeah, I didn't like YouTube being bought by Google, but that doesn't give Viacom to ask for $1 billion, in my right.

Yeah, but Big Media's going to be a much stronger player in future legal actions, at least in the States. Google has like, what, 3 lobbyists, while Viacom seems like a company that's quietly been donating funds to its favorite politicians. Google's a new player, it shouldn't try to press forward too much.

    UGH

Youtube is awesome, who gives a crap if people want to watch videos on a grainy, 4-inch screen on the internet. Why does everything good in this world have to die!

I'd get so mad when good videos would get taken down too, like the one with the mentally retarded kid who had his own cooking show, THAT WAS AWESOME.

I think someone should sue Viacom for sucking, and for being lame. MTV, Comedy central and VH1 can kiss my butt as well, they have about 4 good shows collectively.

There's a lot of huff going on about this at an Avatar Community I'm apart of.

Viacom is doing what they feel necessary to protect how they get to eat at supper time. I can't really blame them. They've worked hard to become a massive empire and youtube is kind of killing that.

My love for Google though, and free videos (i'm poor), is making me cry on the inside, though. :| I love Google and all it's miscellaneous projects and YouTube has been the birth of a magnificent being, BUT, it is hurtful to business when people no longer have to buy merchandise (dvds, etc) and can just download freely.

It's a fair trade, though a little drastic, perhaps.

(for those of you saying Viacom is a bunch of money grubbers, do some homework before you shoot your mouth, please.)

Viacom can go to hell on this case. Youtube enphasizes that the people who upload their videos should not violate copyright laws. It's not youtube's fault but the people who upload videos.

Well considering I'm majoring in business management, I can certainly say that it's not killing their business. It's not even destroying their profits. Viacom is making more money per day than you and I would even think about.

YES youtube is in the wrong, however, but what I'm trying to say is, that it's not wrong enough to be worth 1 billion dollars. Any sort of plagiarism is wrong in my opinion, don't misunderstand me. But the way I see it, they haven't done 1 Billion dollars in damage TO Viacom, therefore they shouldn't have to PAY 1 billion dollars.

And on top of it, not even issue a warning to them to take it down. That is where I get off saying they're money hungry. The professional thing to do, is to contact the other company and inform them of their wrong-doing, and the consequenses that will follow, should they not stop.

Did any of you even read the article? Youtube removes videos the moment they are notified about them so as long as they follow the Digital Millennium Copyright Act they wont loose the case to Viacom. Calm down already.
This is a Sig. It's horribly out of date.

It's not YouTube's fault? Are you serious? Technically, it is their fault as they are responsible for the images, videos, etc represented on their site. They delete anything incredibly inappropriate, so why not delete fully uploaded movies and episodes.

Viacom makes lots of money, yeah, we got that. You're one of those people I was issuing about calling them money grubbers. Thank you for proving my point.

No one SAID anything about saying that it's worth 1 billion dollars. In fact, if you read what I said:

Drastic, as I stated. It's not all holy and fair, but you know what? Quite a bit in this life isn't and never will be. We get over it and grow up, that's life. (Also, please address the FIRST LINE in my signature. Just because you're a so-and-so student or WHATEVER, it doesn't make you intelligent, nor does it mean you know everything NOR does it mean you're right.)

"And on top of it, not even issue a warning to them to take it down."

This proves you know literally NOTHING of the topic at hand. Viacom told YouTube to take down the material over three months ago. YouTube took some of it down, not the requested all. Viacom has given YouTube several outs and several options and YouTube has said "to hell with you, we're doing what we want". (PLEASE, do your homework.) Viacom has a right (both legally and respectivly) to protect it's material, whether it's physically damaging the company or not. Fact of the matter is, THEY OWN IT. They can do whatever the hell they want with it and if they don't want it all over YouTube, I get that.

Being a graphic artist, I make graphics all the time for public use. (Much like Viacom publically introduces it's shows and stuff- we do it for the entertainment and pleasure of others. We don't have to do it, we do it because we want to do it.) I post them on a website for all to see and use. HOWEVER, if some website decided to post my graphics without my permission, even if they gave me credit, I would still be pissed as hell that they went off and did that without my permission. Even though they aren't damaging my work or reputation, they still did it without asking.

YouTube can't control what people say in the video descriptions, so people could be claiming work as their own (STEALING) and YouTube wouldn't have a damn clue. (Yeah, that's really responsible.)

"..and the consequenses that will follow, should they not stop."

This lawsuit is the direct result of YouTube not doing as Viacom had asked them to do on several occasions. As I have just said.

Are you sure they haven't done 1 billion in lost revenue? I'm sure that Viacom has many high paid lawyers that have lots of air tight documentation to back up that monitary claim.

You Tube IS at fault. Just because they SAY on their little agreement "don't violate copywrite laws" doesn't absolve them from all wrong doing. They have the responsibility to police it and make sure that their rules are being upheld. So both parties are equally at fault, one for allowing it and the other for doing it.

Viacom is probably going to win the case. Although I'm not sure if they'll get the full billion, I'm sure they'll probably just settle out of court and you'll start to see stricter restrictions on what you can/can't upload to YouTube.

Oh and everyone going "OMGZORZ NO ALL MY FREE VIDEOS NOOOOOOOO DIE VIACOM LOL!!111!" dont' talk. People make their living by making those videos, they deserve to get dinner and money. You are stealing from them... not the big companies, people like YOU who arn't making tons of money, who are just trying to get by.

YouTube has grainy videos. If someone sees a video there that they really like, they'll go out and buy it from the original companies, so it is a kind of advertisement. A lot of people are stingy though so... <.<

Personally, I'm more concerned about how websites are being sued now. I just watched something on the news earlier about Yahoo being sued because they somehow helped the government against a criminal (or something like that). The Internet has been a sort of haven, different from the real world. I think sites should be able to operate in their own terms, and if they are violating laws, compromises/warnings should be made. As YouTube has failed to heed Viacom's warning... eh. Sucks for them.

    EDIT:

About YouTube's time limit, er, I was able to watch a full episode of BLEACH on there. It ran for about 20 minutes. I would like to add that that was the first (and possibly, the last) video I saw on YouTube. The quality of the vids aren't worth my time to download.

Well, you know, if Viacom would put out a good show every once in a while, they wouldn't have to resort to petty measures such as suing a company for money. -_-' Its not Google's fault Over half the shows on VH1 and MTV are awful rip offs of each other. ^_^'

But Google is in the wrong when it comes to copyrighting. There are full length episodes on Youtube, which I think should be taken down, and a time limit put on videos there. But 1 Billion dollars is a hefty fine. GO GOOGLE! -cheer-

Because they cant be sure what certain companies want to take off, some companies might not care if their show or music is up on the site.

There is a time limit, but there isnt for directors.

The only problem i have with this is if youtube does lose and further law suits follow, will the company shut down? If it does, is that fair on the people who work hard to make their own videos because other people are uploading already copyrighted material.

Viacom owns Nick and all it's rights/shows/etc. (Which means they own Avatar: The Last Airbender. Which is by far one of the best shows I have ever seen, especially to be based off "anime style" and whatnot. VH1 and MTV though.. Keh.)

Unless YouTube/Google is sued by more companies for the same faults, then it's bound to stay open. Regardless, there are many other websites with the same type of features that YouTube provides, though less popular. Yahoo, also a branch of Google, is a demonstration of this. Also, the "beloved" Myspace now offers video storing. And, GOD FORBID, someone purchase their own domain/hosting plan and make a website for themselves. God forbid someone put effort into developing anything for themselves. Because complaining and quitting is just so much easier, why bother?

Great, so when someone comes into your house and steals your stuff, you'd like them to just get a "comprimise/warning" right? You don't get your stuff back, they just get a warning, "don't go do that again OK?" You are failing to realize that its NO DIFFERENT THAN THAT. Just because its a bigger company, just means that what is stolen is a larger amount.

Viacom does a lot actually. They do put out good shows, obviously good enough for people to steal and put on YouTube.... Its not viacom its todays society....

You people fail to realize that there is a subculture of "get it for free" MP3's, videos, movies, everything... People don't go out and buy CD's or DVD's anymore, they download it from the internet and burn it. You think its OK, because its socially accepted, but you also fail to see the consequences of your actions. Its not OK, its still stealing. You just justify it and sleep better at night.
