The Michigan Court of Appeals, ruling in November, said an obscure but unambiguous state law makes any "sexual penetration" a serious sexual assault if it occurs during any other felony, including simple adultery, with a maximum penalty of life in prison.

No such thing as "simple adultery". Just because it doesn't result in anyone dying doesn't mean it should be refered to as simple. Adultery can have a serious and drastic effect on a family. It's a terrible thing for one person to do to another and while I don't think it is necessary to put a life sentence on it, it should not be minimized by those kinds of terms.

The problem is that it has become so wide spread and common in society thata lot of people don't even view it as a bad thing. They just throw around sugar coating terms like "extra marital affair" to make it sound less threatening. Some things you just shouldn't try to be politically correct with.

So, if you think about it, youre signing a contract with your spouse and the government. Adultry is breaking this contract, which should be punishable. Maybe not a life sentence, but perhaps a few months in prision, a fine, things of that nature.

A marriage is a moral contract, and if you need to punish people for breaking it, you have already lost the battle. A government should not regulate morality, morality should regulate government.

Marriage is what it is, and in my opinion it's a thing of honor and a show of your resolve in loving and trusting another person.

I don't think you want your spouce/bf/gf having that act of passion with another of their own free will, because what does that show? He/she isn't committed and thus doesn't hold that 'absolute' love for you.

Now I myself think the punishment should range between various things, and out of those 'catagories' the victim, said wife/husband should be ableto choose from that list.

I mean it's their trust and love that's being broken, thus it should be their right to have a say in the matter.

It's not a battle of what's wrong or right. An affair is a personal, moral agreement. Charging someone with a sentence for a private pact like that is absolutely ridiculous. Its not an agreement, its a VOW. Why do you think you exchange vows in a wedding? You vow to love and honor that person and that person only. Fooling around with another person breaks that vow. Lets say we were living in older times, or in another country even. The punishment for adulty in some countries/in the past was DEATH. Now, I think a few months in jail isnt all that bad. In fact, even life in jail isnt even all that bad. Beats being excuted, right?

I think the goverment shouldn't get involved with it. A life sentence is really harsh. The goverment just want to nag people with moral ideas that are common sense, and if anyone is dumb enough to break those morals the goverment should not get involved. The spouse can divorce them and they lose the one thing they could be happy with because of their shortsightedness. It isn't. Not even close. It is a completely different phenomenon. Rape is a violent crime about asserting control over a person and ipso facto making them feel powerless. Adultery is almost always either an expression of disinterest coupled with cowardice or simply an inability to be close to another with a need to ruin the relationship because of it. Only rarely is it some sort of nasty scheme to get back at the spouse.

They come from completely different places and have completely different aims, and I am willing to bet anyone that has been raped would have much rather just been cheated on, no matter what the circumstances. It's like saying Vehicular Manslaughter is as bad as Murder in the first degree.

It sounds like a blue law to me. All states have them. Most are ridicoulous and stupid made years and years ago. Just like years and years ago you couldn't have any businesses opened on a Sunday.

Michigan also has this as a law.

A woman isn't allowed to cut her own hair without her husband's permission.

Yes Bean is absolutely correct about the legal status of this obscure law technicality. It has been stated in other sources that it is unlikely that any judge will throw down a life sentence.

As for my stance on Adultery in law, I believe that Adultery is between those involved and not something necessary to be enforced by law. Although being cheated on is awful, it is not a violent crime in any way. And besides it is often the case that Divorce courts really inflict wrath on those who are cheated on anyways.

I don't even know where to begin with your arguments. I'm just absolutely gobsmacked by some of the things you had to say.
All I'm going to say is that this is the United States, not *insert some random country here*. To say one offense is punishible in a worse manner than here is to be comparing the proverbial apples and orange. I could go on, but I think MP2K has tackled things in a more rational manner than I can manage at the moment.

It used to be punishable here. I.E The Scarlett Letter. But, this was during the Puritan age.
Yes, this is the land of the free, but we let people get away with WAY too much, adultry being one of them.
We dont allow drunk driving because it could have dangerous after affects. Same wih doing drugs. Adultry could have the same potential to have dangerous after math (i.e Fatal Attraction).
For all anyone knows, adultry could cause a person to:
-kill themselves
-kill their spouse
-kill their spouse's mistress/umm...male mistress o_O
-vandalisim (spouses car, things of that nature)
-stalking
-mental breakdowns
-a combination of any of the above.

We dont allow drugs and drunk driving because of what they might do to others, this should be handeled the same way.

95% of the time it takes 3 people, for someone to cheat. And all 3 are guilty. So both partners and the 3rd party should be punished, if punishment is going to be given out for adaultery.

Your stuff on not paying taxes and doing jail time I just do not get. You live in America, and you know there are millions who do not pay ther taxes every year, and half of them haven't for years. They are not in jail, nor will they be heading there fast. It is why we have to watch dumb comercials about if you pay your taxes now, you wont be penalized. What I dont understand is how all three people are guilty in adultry. So, because my ex cheated on me, its somehow my fault too? That absurd. Theres even cases where the mistresses dont even know their boyfriend is married, how is that their fault???
I dated a guy who kept pressing me to have sex, and I just wasnt ready, espically after only dating him for about four months. Turns out, he went behind my back and slept with another girl who had no knowledge of me and my relationship with said boyfriend. It wasnt until I called him and heard her in the background. Thats when both of us learned what he was doing to both of us. Now, how was that our fault?
Let say for the sake of arguement that him and I were married. He tells me hes going off with some friends and, being the trusting wife I am, let him go. Turns out, he's with some girl. Is it my fault he cheated?
Most men cheat because they arent getting attention from their wife, but it may not be the wifes fault at all, like when shes pregnant. Sure, you can have sex the first few months, but you cant after a certain period of time, which can leave months of no sex.

If you are a couple, and you have real love and affection equally, (key word is equally) no one can tempt you or your partner to do anything.

I will not even attempt to touch your personal experience because all I am hearing is your side. There is always two sides to a story, and both have to be heard to see what has happened, by the views of both parties. And with this story of yours there is 3 sides. And for all you know, the 3rd party lied jsut as bad as your bf. And that has happened with other relationships where the "other" girl pretended she didnt know anything about the relationship.

I never said thats the only reason why men cheat, but it seems to be a main reason. Again, Im giving examples, no where am I saying that Im stating facts or studies.
Yes, I know women cheat as well, but I only know of one girl to have cheated on her boyfriend, while I know ten guys who have done the same.
My ex cheated on me because I wouldnt put out. He told me himself during our breakup.
My mothers friend Eddie cheated on his wife because she was pregnant and he told my mother.
My best friend's ex cheated on her because she wouldnt perform certain sex acts with him.
Seems sex is a big part of it. Sure, some do it because they fall in love with this other person, and may still have feelings for their spouse, but this isnt the number one reason why people cheat.

As for the other girl, did she lie to me? I dont know. I dont care. The point is, he didnt have enough respect for me to tell me "look, Im getting attention from somewhere else."
