*ahem* Alright. So, long story short for those who don't want to read, a 14-year-old girl took naked photographs of herself and put it on MySpace. She has been arrested for possession and distribution of child pornography.

Of herself. That she herself took.

Great job.

I think it's so utterly ridiculous I can't do anything BUT laugh, or else I'd probably cry. This girl, stupid though she is for putting them on MySpace "for her boyfriend," willingly and knowingly took nude pictures of herself. Nobody coerced her, nobody bribed her, and the only person that exploited her, was herself. Even taking that into account, she wasn't exploiting the fact that she was a 14-year-old, she was exploiting the fact that she was female and, to her and her boyfriend at least, attractive. This is the photograph equivalent of charging her and her boyfriend with statutory for having sex with minors(provided they're both the same age).

Thoughts? Opinions?

While I certainly cannot claim to know anything about this young girl other than what has been mentioned of her in the article, she should be old enough to realize just how foolish she was for posting such pictures on a popular site like YouTube. Honestly, even if those pics were up for an hour or so, that could still provoke untold numbers of people to save them and do whatever they want with them at any time. Saying it was "for her boyfriend" sounds rather flimsy to me, and makes me think that there's more to this story then what was being told.

As to the charges brought against her... well, while I'm not sure just how the prosecution is going to handle the case against her, I'm fairly certain this will be portrayed as more of a message to the general public and young girls everywhere rather than to punish.

You do have some good points there, but come she's still a kid. True it was a stupid idea to post such things over the interweb, but you still gotta remember she's still a kid.

And yes i think this will portray a message for the public rather than a punishment for her.

Based on a number of articles I've read, this stuff is becoming more common. For example, some kids were charged with Distributing CP after they received an unsolicited boob-shot via cell-phone. The problem is that the laws, such as they are, don't discriminate for the age of the distributor.

Law enforcement officials ~~can't~~ shouldn't selectively enforce the laws and judges don't have much leeway to interpret, so they still wind up tried, albeit as minors and are given a slap on the wrist (usually). If this stuff comes before a Jury, it's perfectly ok for the Jury to find them innocent in spite of their obvious guilt (or "guilt" as the case may be). That juries are not required to rule in full accordance with the evidence is the dirty secret of the legal establishment. So until the laws change this will be an issue. I foresee Distributing CP becoming a misdemeanor that doesn't require registering as a sex offender for minors.

Have we gotten this far to who gets to be naked and who doesn't get to be naked.
If she was smart enough and if they were really for her boyfriend, she could have placed and option for only him to see.
I don't see what is wrong with exploring who you are.
She is exploring who she is, she is expressing her femininity, she is learning how to express herself in sexual manners.
Yes, maybe she shouldn't have placed them on Myspace.
But for all I care, she was expressing who she is her femininity, she was exploring her femininity, and there should be nothing wrong with that.

Wait, what? Roll back time a bit and say I'm 16. I take pictures of myself in the buff and print off a bunch of copies. I hand one to my girlfriend, and post the rest on a bulletin board my HS cafeteria for anyone to see. Tell me these actions would not be stupid. I don't think such an act is felony worthy, but it's easy to see why it should be illegal.

It's all these religious straints that makes us believe naked is sexual and sexual is bad.

When we were cavemen for our first years we were naked.

Nature had made use naked, it's natural to want to explore yourself.

She's a child, for goodness sake. She doesn't need to be involved as something as sexual as posting nude pictures of herself on any site, regardless of what the circumstances are surrounding it. I hold serious doubts as to whether or not she understood the full consequences of her actions. So let us not, under the guise that human sexuality and nudity are beautiful, say that it's alright to allow an innocent child to expose herself to a world that she is not ready for.

I mean, honestly, can any of us even imagine the consequences that this one incident could could for her? It could very well be twenty years into the future, and she could be a successful, intelligent young woman, and these pictures could still come back to brand her with a mark of shame.

Nude is not pornography.
And expressing yourself isn't pornography either.
It isn't art, but it's certainly not pornography.

Apparently you weren't listening very closely when I said it the first time around, so I'll try to make it a little clearer so, hopefully, you can understand. A human's choice to express his/her sexuality is a private matter that should be given its own range of freedom; however, a child cannot make that choice. They do not have the maturity nor the life experience to realize the consequences of said actions, and how they can come back to haunt them for the rest of their lives.

Therefore, it is not alright for a child who does not understand what she's doing to expose her body to however many innumerable numbers of people.

I have no problem with nudity.

But clearly this girl didn't have all her bearings in order posting these kinds of pictures on the pedophile carnival known as myspace.

As for the arrest, well, isn't a violation of myspace "rules" to post nudes of yourself on there? I wouldn't know since I never had one.

You keep calling her a child, but any 14 year old should have enough common sense to know the consequences of doing something as stupid as posting nudes of him/herself on a site where anybody could easily track him/her down. Hell, I had that much common sense when I was 8.

And @ Shy Satan's Child; I think what Shinn Kamiyra is trying to point out is the fact that it was very dangerous for her to be posting nudes of herself on the internet.

Well, she can kiss her future goodbye. Even if the punishment is lenient since she's a minor, she'll be a registered sexual offender, for the rest of her life. Megan's law is such a blast.

For goodness sake, don't relegate this to being okay simply because we choose to classify her as a child or a teenager. If that's what you want, we'll refer to her as a teenager; because, quite frankly, one way or the other, that still doesn't make this okay. Should she be charged with child pornography of pictures of herself that she took herself with having to be forced to do so? No

Should be be charged with indecent exposure? YES

Nudity isnt something to be ashamed of. Taking a picture of your toddler running around in your backyard in their birthday suit isnt wrong in any way shape or form. Now, posting those pictures ONLINE is. Why? Because you give strangers access to those pictures. Want to share them with your loved ones? Email them directly or use the post office.

Yes, theres nudity in art and you can argue that it couldve been "art", but allow me to point out that sites that DO show nudity as art have big WARNINGS that there are nude people in the gallery. Same thing as an actual gallery/museum, they need to post that the exhibit contains nudity. This girl's myspace page isnt an art gallery and chances are there were no warnings that the pictures were there, which means its indecent exposure. She gave viewers no opportunity to decide if they wanted to view her in the buff or not, which is a huge no-no in my book.

Yes, you have the right to be naked. You do -not- have the right to force others to see you naked. And to me, this is the main problem of the case.

I have no problem with nakedness and sexuality, but whining about it on a Animu board is never going to change that society for various reasons does. If an adult wants to try to go around in the buff, I salute them for their courage (although certainly not their intelligence). However, that is a far cry from JB posting porn of themselves on the internets.

P.S. Quit inserting a carriage return after ever single sentience. It's annoying, and makes you read really, REALLY airy. It's one of those things that makes everything you wrote impossible to respect, but the incessant repetition didn't help either.
